Article 1 (Purpose)

These Terms set out the rights, obligations, and responsibilities between Dolphin in Cali (the "Company") and users, together with other necessary matters, in connection with use of the MOVO AI-based presentation creation service (the "Service") provided by the Company.

Article 2 (Definitions)

The terms used in these Terms are defined as follows:

  • "Service" means the AI-based presentation creation and editing tools provided by the Company.
  • "User" means a member or non-member who uses the Service provided by the Company under these Terms.
  • "Member" means a person who has entered into a service agreement with the Company and been issued a user ID.
  • "Credits" means the virtual usage entitlement required to use AI features within the Service.
  • "Paid Service" means the various premium features and subscription services the Company provides for a fee.

Article 3 (Publication, effect, and amendment of these Terms)

1. The Company posts these Terms on the initial screen of the Service or on a linked screen so that users can read them easily.

2. The Company may amend these Terms where it deems it necessary. When it does so, it will give notice on the initial screen of the Service, stating the effective date and the reason for the change together with the current Terms, from 7 days before the effective date until the day before it.

3. Users have the right not to agree to amended Terms, and may stop using the Service and withdraw if they do not agree. However, continuing to use the Service after the amended Terms take effect is deemed acceptance of the changes.

Article 4 (Provision and modification of the Service)

1. The Company provides the following services:

  • AI-based automatic presentation generation
  • Presentation editing and design tools
  • Project saving and management
  • Export in various formats (PPTX, PDF, Figma, PNG)
  • Other services determined by the Company

2. Where the Company changes the content of the Service, it will give advance notice stating the reason for and content of the change.

3. The Company may modify or discontinue the Service it provides where operationally or technically necessary.

Article 5 (Membership registration)

1. A user applies for membership by entering member information on the registration form prescribed by the Company and indicating agreement to these Terms.

2. The Company registers applicants under paragraph 1 as members unless any of the following applies:

  • The registration details contain falsehoods, omissions, or errors
  • The applicant has previously lost membership status
  • Registration as a member is otherwise judged to cause significant technical difficulty for the Company

3. The membership agreement is formed at the time the Company's acceptance reaches the member.

Article 6 (Withdrawal and loss of membership)

1. A member may request withdrawal from the Company at any time, whether or not they hold a subscription. Where an active subscription exists, one of the following two flows applies.

  • (Default) The member cancels the subscription themselves in subscription management and withdraws after the billing period ends.
  • (Immediate withdrawal) The member withdraws after requesting and completing a refund for the remaining period. Refund calculation and procedure follow the Refund Policy.

Where unused one-off credit purchases exist, withdrawal is completed after those are refunded (expired credits excluded).

2. The Company may restrict or suspend membership where a member falls under any of the following:

  • Registering false information when applying to join
  • Threatening the order of electronic commerce, such as by interfering with another person's use of the Service or misappropriating their information
  • Using the Service to act in a way prohibited by law or these Terms, or contrary to public order and morals

3. On withdrawal, personal data such as the account, profile, and content created by the member is destroyed immediately and cannot be recovered. However, order, payment, and subscription contract records are moved to a separate retention area and automatically destroyed after 7 years, as required by applicable law (Act on Consumer Protection in Electronic Commerce §6 / Value-Added Tax Act and Corporate Tax Act). During the retention period this data is not accessible to ordinary users; the Company's operators may access it directly only for legitimate reasons such as dispute resolution or tax compliance.

4. Where a member signed up with an external account (OAuth such as Google), the Company clears the authentication link between its system and that external account on withdrawal. However, the Company has no means of revoking the app permission registered on the external account, so the member must revoke it themselves on that account's security page (see section 6, Rights of the data subject, in the Privacy Policy for details).

5. Payment data held by the payment processor (Lemon Squeezy) is governed by the processor's own policy and is not directly controlled by the Company.

Article 7 (Use of and payment for Paid Services)

1. A member wishing to use a Paid Service provided by the Company must pay the fee in accordance with the charges and payment methods set by the Company.

2. Payment for Paid Services is made through the payment processor designated by the Company, and payment-related information is handled in accordance with that processor's policy.

3. Subscription services renew automatically at the end of the subscription period, and members may cancel automatic renewal at any time before the subscription expires.

4. Credits included in a subscription plan are valid only for that billing cycle; unused credits do not carry over to the next billing cycle and expire. One-off purchased credits are valid for 90 days from the date of purchase and expire automatically thereafter.

5. The Company gives advance notice of the content and effective date of any introduction, change, or termination of pricing or credit policies. Members who joined or paid before the policy change may retain the Terms and pricing applicable at the time of joining for a certain period (each, a "Grandfather member"). Where a Grandfather member voluntarily cancels their subscription or switches to another plan, the previous benefits are not restored.

6. Additional one-off credit purchases are available only to paid subscribers (Pro / Max or Grandfather Basic). One-off purchases are not available on the Free plan; purchase becomes possible after switching to Pro or Max.

Article 8 (Refunds)

1. Refunds are, as a rule, not available from the Company, but are permitted in the following cases.

  • Remaining subscription period on withdrawal — the unused remaining period as at the withdrawal request is refunded on a pro-rata daily basis (monthly subscriptions only)
  • Unused one-off purchased credits on withdrawal — refunded in the proportion of unused balance / total purchased credits × purchase amount (expired and used credits excluded)
  • Where there is a problem with use of the Service — refund, restoration, or compensation following individual review, limited to cases such as service interruption, material defects, payment errors or duplicate charges, or work not completed due to system error

2. Under Act on Consumer Protection in Electronic Commerce §17, you may exercise the right of withdrawal within 7 days of the date the goods or services were supplied. However, for items whose use has already begun, such as digital content, the right of withdrawal may be restricted under §17(2) of the same Act.

3. Refunds are executed through the payment processor (Lemon Squeezy) and may take 5–10 business days to process (bank posting times are separate).

4. For the specific calculation and request method for refunds, please see the separate Refund Policy page.

Article 9 (Obligations of the Company)

1. The Company will not act in a way prohibited by law or these Terms or contrary to public order and morals, and will use its best efforts to provide the Service continuously and reliably.

2. The Company establishes security systems to protect users' personal data, and publishes and complies with its Privacy Policy.

3. Where the Company recognises as justified an opinion or complaint raised by a user in relation to use of the Service, it must address it.

Article 10 (Obligations of members)

Members must not do any of the following:

  • Register false information when applying or making changes
  • Misappropriate another person's information
  • Alter information posted by the Company
  • Transmit or post information other than that specified by the Company (such as computer programs)
  • Infringe the copyright or other intellectual property rights of the Company or any third party
  • Damage the reputation of, or interfere with the business of, the Company or any third party
  • Disclose or post on the Service obscene or violent messages, images, audio, or other information contrary to public order and morals
  • Use the Service for commercial purposes without the Company's consent
  • Reproduce, transmit, publish, distribute, broadcast, or otherwise use information obtained through the Service for commercial purposes, or allow a third party to do so, without the Company's prior consent

Article 11 (Ownership of copyright and restrictions on use)

1. Copyright and other intellectual property rights in works created by the Company belong to the Company.

2. Users retain copyright in content they create using the Service, and the Company may use it only for the purposes of operating and improving the Service.

3. AI-generated content provided by the Company is produced on the basis of the user's prompts and choices, and users may freely use that content for any purpose, including commercial purposes. However, users are responsible for ensuring that the generated content does not infringe the rights of third parties.

Article 12 (Disclaimers)

1. The Company is released from responsibility for providing the Service where it cannot do so due to a natural disaster or equivalent force majeure.

2. The Company is not liable for impediments to use of the Service caused by reasons attributable to the member.

3. The Company does not warrant the accuracy, reliability, or legality of AI-generated content, and users must review and use generated content at their own responsibility.

4. The Company has no obligation to intervene in disputes arising through the Service between members, or between a member and a third party, and bears no liability to compensate for damage arising from them.

Article 13 (Dispute resolution)

1. The Company establishes and operates a damage compensation body in order to reflect justified opinions or complaints raised by users and to compensate for their damage.

2. Disputes arising between the Company and a user may be subject to mediation by the Electronic Document and Electronic Transaction Dispute Mediation Committee established under the Framework Act on Electronic Documents and Transactions.

3. Any lawsuit between the Company and a user is governed by the laws of the Republic of Korea, and the court with jurisdiction over the location of the Company's head office is the agreed court of jurisdiction.
